Relocation of a minor abroad is qualitatively distinct from ordinary travel—it constitutes a permanent or long-term planned change of the child’s habitual residence, which fundamentally affects the exercise of parental rights and responsibilities as well as the territorial jurisdiction of the court. The child integrates into a new environment, attends a new school, and their center of main interests shifts outside the territory of the Slovak Republic.
Because this constitutes a matter of essential importance within the meaning of Section 35 of the Act on Family, the consent of both parents is legally required for relocation. If the parents fail to reach an agreement, a petition may be filed with the court to substitute the non-consenting parent’s consent. Our firm provides comprehensive legal advisory and representation in these proceedings.
