An emergency measure regarding a parent’s maintenance obligation to a child (neodkladné opatrenie vo veciach výživného) serves to provide immediate protection for the child’s essential living needs in situations where a parent fails to meet their support obligations voluntarily and no prior court order exists.
Under Section 366 of the Code of Civil Non-Contentious Procedure (CMP), the prerequisite for issuing an interim injunction is the existence of a statutory maintenance obligation pursuant to Section 62 et seq. of the Act on Family, along with substantiation that the child’s maintenance would be genuinely at risk without judicial intervention. The nature of this measure is strictly provisional—it is intended to bridge the period until a final judgment on the merits is rendered, and the court orders it only to the extent strictly necessary.
