The provision of healthcare to a minor child—such as decisions regarding vaccination, surgical procedures, or specialist consultations—constitutes a matter of essential importance relating to the exercise of parental rights and responsibilities within the meaning of Section 35 of the Act on Family. Parents are legally required to decide on healthcare matters jointly and reach a mutual agreement reflecting the best interests of the child.
If the parents fail to reach an agreement, either parent may petition the court to substitute the non-consenting parent’s consent. Our firm provides comprehensive legal advisory and courtroom representation in proceedings concerning the substitution of consent for a minor child’s healthcare services.
